These Terms & Conditions (“Terms”) govern your use of our website and the purchase of customized gifts, including but not limited to laser-cut items, engraved products, personalized gifts, and customized T-shirts (collectively, the “Products”). By accessing our website or placing an order, you agree to be legally bound by these Terms, which form a binding agreement between you (“Customer” or “you”) and Nanmayil. Nanmayil operates exclusively within the territory of India. Please read these Terms carefully before making any purchase. If you do not agree with any part of these Terms, you must not use our website or avail of our services.

2. Eligibility

By using our website or placing an order, you represent and warrant that: You are at least 18 years of age and competent to contract as per the Indian Contract Act, 1872; You are a resident of India and intend to receive delivery within India; You are using our website and services for lawful purposes only.

2.2. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if eligibility conditions are not met.

3. Orders & Contract Formation

3.1. Order Placement All orders must be placed via our official website. By placing an order, you agree to provide accurate and complete information, including customization details, delivery address, and contact details.

3.2. Order Acceptance An order is considered accepted only upon our written confirmation (including via email or order dashboard confirmation). We reserve the right to refuse or cancel any order at any time due to product unavailability, errors in pricing or product information, or doubts concerning the legitimacy or intent of the transaction.

3.3. Customization Accuracy For customized products, you are solely responsible for providing correct specifications, including text, images, sizes, and personalization details. Nanmayil will not be liable for errors in customization resulting from incorrect or incomplete information provided by the customer.

4. Pricing, Payments & Taxes

4.1.Product prices Product prices are listed in Indian Rupees (INR) and are exclusive of applicable taxes unless otherwise stated. Prices may be updated at our discretion and without prior notice.

4.2. Accepted Payment Methods:

• Unified Payments Interface (UPI)
• Debit & Credit Cards (Visa, MasterCard, RuPay, etc.)
• Net Banking

4.3. All payments must be made in full at the time of order placement. Your order will not be processed until payment is successfully received.

4.4. Invoices will be provided electronically. You are responsible for ensuring accurate billing information.

4.5. All applicable taxes, levies, or duties will be added to the invoice as per the prevailing rates required by Indian law.

5. Shipping & Delivery

5.1. Delivery Partners We dispatch orders through reputable courier partners, including: DTDC, BlueDart, Delhivery, India Post, and Professional Couriers.

5.2. Timelines Estimated timelines displayed at the time of purchase are indicative and may vary due to location, customization requirements, or external factors.

5.3. Risk of Loss The risk of loss and/or damage passes to you once the order is handed over to the courier.

5.4. Delivery Delays We are not liable for any delay in delivery caused by factors beyond our reasonable control, including but not limited to courier delays, natural disasters, strikes, or unforeseen circumstances.

6. Returns, Refunds & Cancellations

6.1. No Returns or Refunds on Custom Orders As our Products are made-to-order and personalized, we maintain a strict no returns or refunds policy except in the following cases: Damage during transit (intimated with proof of unboxing and photographs/video within 24 hours of receipt) Manufacturing defects identified upon delivery Incorrect item delivered (mismatched with order confirmation details)

6.2. T‑Shirt Orders No returns or refunds for size or fit issues unless the product is defective. Please refer to our size charts and customization preview before placing your order.

6.3. Refund Process Eligible refunds will be initiated within 7 business days of approval and processed to the original payment method. Processing time by banks or payment gateways may vary and is outside our control.

6.4. Returns Procedure If your order qualifies for return, contact us within 24 hours of receiving the item(s) by email. You must provide comprehensive proof (photos/videos) and retain original packaging.

7. Customer Content Policy

7.1. By uploading or submitting any content (photos, text, designs, logos, etc.) for customization, you: Warrant that you own or otherwise have legitimate rights to such content, Confirm there are no third-party intellectual property or trademark violations, Indemnify Nanmayil and its affiliates from any claims, damages, or liabilities arising from the use of such content.

7.2. We reserve the right to refuse or cancel any order if we believe the customer content may infringe the rights of others or violate any law.

8. Intellectual Property Rights

8.1. All original content on the Nanmayil website including product designs, graphics, text, logos, photographs, and the Nanmayil brand are the exclusive property of Nanmayil and are protected by Indian copyright, trademark, and intellectual property laws.

8.2. Unauthorized copying, reproduction, distribution, modification, or use for commercial purposes is strictly prohibited.

8.3. Use of the website or purchase of products does not grant you any rights to our intellectual property other than personal use of the purchased items.

8.4. Any feedback, suggestions, or recommendations voluntarily submitted by users may be used by Nanmayil without any obligation to compensate.

9. Limitation of Liability

9.1. To the maximum extent permitted by applicable law: Nanmayil is not liable for any indirect, incidental, consequential, or punitive damages arising out of use of our website, products, or services. We are not responsible for losses or damages resulting from courier delays, customer-provided errors, non-compliance with care instructions, acts of God, power failures, or other events beyond our reasonable control. Our total liability for any claim shall not exceed the amount paid by you for the specific product(s) involved in the claim.

10. Force Majeure

10.1. Nanmayil shall not be in breach of these Terms or liable for delay or failure to perform if such delay or failure is due to events beyond our control, including but not limited to natural disasters, epidemics, lockdowns, fire, flood, act of government or public authorities, strikes, interruption of transport, or telecommunications failures.

11. Termination & Suspension

11.1. Nanmayil reserves the right to terminate, suspend, or restrict your account, access to the website, or fulfillment of any order at any time, without notice, in circumstances including but not limited to: Violation of these Terms, Provision of false or misleading information, Fraudulent activity or misuse, As required by law or governmental authority.

11.2. Upon termination, the clauses intended to survive (such as intellectual property, limitation of liability, governing law, jurisdiction, and dispute resolution) will remain in effect.

12. Governing Law & Compliance

12.1. These Terms & Conditions are governed by and construed in accordance with the laws of India, including but not limited to: The Indian Contract Act, 1872 The Consumer Protection Act, 2019 The Information Technology Act, 2000 The Consumer Protection (E-Commerce) Rules, 2020 Any rules, regulations, or orders enacted under the above statutes.

13. Jurisdiction

13.1. All disputes, claims, or controversies arising out of or relating to these Terms, your use of the website, or purchase of products shall be subject to the exclusive jurisdiction of the courts situated in Erode, Tamil Nadu, India.
